These Terms of Use (“Terms”) govern your access to the CC Training website and your use of the personal training, online coaching, nutrition coaching, challenges, and retreat services offered by CC Training (“CC Training,” “we,” “us,” or “our”).
Please read them carefully. By using this website, requesting a consultation, or purchasing any coaching service, you agree to be bound by these Terms. If you do not agree, do not use the site or our services.
1. Who May Use Our Services
You must be at least 18 to purchase coaching services. If you are between 13 and 17, a parent or legal guardian must agree to these Terms on your behalf and stay involved in your coaching. This website is not directed to children under 13.
2. Not Medical Advice
CC Training provides fitness, nutrition, and lifestyle coaching. We are not physicians, dietitians, physical therapists, or licensed healthcare providers, and nothing on this website or in any coaching session is medical advice, diagnosis, or treatment.
Everything published here — articles, calculators, tools, downloadable materials, and coaching recommendations — is general educational content. It is not a substitute for advice from a qualified healthcare professional who knows your history.
Consult your physician before beginning any exercise program, changing your diet, or taking any supplement — particularly if you are pregnant or nursing, have a medical condition, are recovering from injury or surgery, or take prescription medication. Never disregard or delay professional medical advice because of something you read here or discussed in a session.
If you experience chest pain, dizziness, shortness of breath, or any other concerning symptom during exercise, stop immediately and seek medical attention.
3. Calculators and Tools
Any calculator, estimator, or risk tool on this site produces a general estimate from population-level formulas. These tools are not diagnostic, they do not account for your individual circumstances, and they must not be used to make medical decisions. Discuss any result that concerns you with your physician.
4. Assumption of Risk
Physical exercise carries inherent risk, including muscle strain, sprains, fractures, cardiovascular events, aggravation of an existing condition, and in rare cases serious injury or death. That risk exists whether you train in person, follow a program remotely, or take part in a challenge or retreat.
You are responsible for disclosing any medical condition, injury, limitation, medication, or symptom that could affect your safety. You are responsible for working within your own limits, using proper form, stopping when something hurts, and telling your coach when something does not feel right.
By taking part in any CC Training service, you voluntarily assume these risks and agree that you participate at your own risk.
5. No Guarantee of Results
Health and fitness results depend on many things we do not control — your consistency, effort, genetics, sleep, stress, medical history, and how closely you follow the plan. Any testimonial, progress photo, statistic, or success story on this site reflects one person’s experience and is not a promise that you will achieve the same or similar results.
6. Sessions and Scheduling
Service formats, session lengths, and program durations are described at the time of purchase. Sessions are scheduled by agreement between you and your coach.
All training has a minimum 24 hr cancellation policy with any CC Training subscription. Sessions canceled prior to the 24 hr period will be credited to the end of the month. Sessions canceled with less than 24 hours’ notice, or missed without notice, may be forfeited.
7. Payment and Refunds
Payment is due in monthly installments prior to services being rendered. Accepted payment methods are listed at the time of purchase. Fees may change with notice, and a change will not affect a period you have already paid for.
Unless we agree otherwise in writing, purchased sessions and packages are non-refundable and non-transferable. If you need to pause or stop your coaching, contact us and we will work with you in good faith.
If a payment fails or an account falls past due, we may suspend services until the balance is paid.
8. Nutrition, Supplements, and Affiliate Relationships
Nutrition coaching is educational. It is not a prescription, medical nutrition therapy, or treatment for any condition. If you have a diagnosed medical condition, an eating disorder, or a food allergy, or you are under the care of a dietitian or physician, follow their guidance.
We may recommend nutrition products or supplements, and we may earn a commission if you buy through our links. A recommendation reflects our genuine opinion and does not change the price you pay. Dietary supplements are not evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.
9. Your Conduct
You agree to give us accurate information, keep any login credentials confidential, and tell us about unauthorized use of your account. You agree not to:
- Use the site or services for any unlawful purpose.
- Copy, resell, distribute, or share programming, materials, or session content with anyone else.
- Attempt to gain unauthorized access to the site, its servers, or another user’s information.
- Interfere with the site, introduce malicious code, or scrape content by automated means.
- Harass, threaten, or abuse a coach, staff member, or another client.
- Impersonate another person or misrepresent your affiliation with anyone.
10. Intellectual Property
The site and its content — text, training programs, nutrition guidance, articles, graphics, photographs, video, logos, and the CC Training and Get It Back™ names and marks — are owned by CC Training or its licensors and protected by copyright, trademark, and other laws.
We grant you a limited, personal, non-exclusive, non-transferable license to use the materials we provide for your own training. You may not reproduce, distribute, publish, or create derivative works from them, or use them to train other people, without our written permission.
11. Content You Send Us
If you send us photos, video, messages, or reviews, you keep ownership of them. You grant us a non-exclusive, royalty-free license to use that content for the purpose you sent it. We will not publish your photos, results, or testimonials publicly without your separate written permission.
You confirm that anything you send is yours to send and does not violate anyone else’s rights.
12. Third-Party Links and Services
This site links to third-party websites, scheduling tools, and products. We do not control them and are not responsible for their content, practices, or availability. Your dealings with a third party are between you and that third party.
13. Disclaimer of Warranties
The website and all services are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any content is accurate, complete, or current.
14. Limitation of Liability
To the fullest extent permitted by law, CC Training and its owner, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or personal injury arising out of or relating to your use of the website or our services, whether the claim is based in contract, tort, negligence, strict liability, or anything else.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to these Terms or our services will not exceed the amount you paid us for services in the three months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless CC Training and its owner, employees, contractors, and agents from any claim, demand, loss, liability, or expense — including reasonable attorneys’ fees — arising out of your use of the site or services, your violation of these Terms, or your violation of any law or the rights of a third party.
16. Termination
We may suspend or end your access to the site or to coaching services at any time, with or without notice, if you violate these Terms or if we believe continuing is not appropriate. You may stop using the site at any time. Provisions that by their nature should survive — including intellectual property, disclaimers, limitation of liability, and indemnification — survive termination.
17. Governing Law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or our services will be brought exclusively in the state or federal courts located in Washington County, Utah, and you consent to the jurisdiction of those courts.
18. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Continuing to use the site or our services after an update means you accept the revised Terms.
19. Entire Agreement
These Terms, our Privacy Policy, and any written coaching agreement you sign are the entire agreement between you and CC Training regarding the site and our services. If any provision is found unenforceable, the rest stay in effect. Our failure to enforce a provision is not a waiver of it.
